A foreigner is seeking to cite Director General of Kenya Citizens and Foreign Nationals Management Service for contempt of court.
The Indian National, Kulraj Singh Bhangra wants Mwende Gatabaki held in contempt of court for disobeying a court order issued two years ago directing he be given citizenship.
Bhangra is accusing Gatabaki of refusing to comply with orders issued by Justice Lenaola to consider his application for citizenship.
Justice Lenaola had directed the Immigration body to consider the petitioners application within 45 days of the Judgment date.
According to Bhangra, a copy of the Judgement was served to the Immigration and Prosecutions Department but no action has been taken.
“It is my sincere belief that the government operates through officials and orders of court of competent jurisdiction against the government are meant to be obeyed by the government through designated officer. The conduct of the respondent herein has undermined the Court’s authority and there is need to take decisive action against the respondent,” he said in court documents.
Bhangra claims that it’s the duty of Director General of the Kenya Citizens and Foreign Nationals Management Service to ensure that orders issued in court are complied with and the application for citizenship is processed within the time frame stipulated.
Justice Isaac Lenaola will deliver the ruling of the application on May 27.
